CANCELLATION, RETURNS & REFUND POLICY
 
This policy outlines the terms and conditions under which Clients may cancel their services and request refunds for the services provided by us. Our aim is to ensure transparency and provide a clear understanding of our policies regarding cancellations and refunds. By using our service, you agree to adhere to the terms set forth in this policy. Please read this Policy carefully, as it forms a binding agreement between you and MOIOTSO Limited.

DEFINITIONS
Unless expressly stated otherwise, all the capitalised terms used in this Policy shall have the same meaning as ascribed to them.
 

SERVICE DESCRIPTION
We use our best endeavour to provide accurate and materially complete description of all the services, and work we do, and its requirements. However, we do not warrant that such description will always be accurate, complete, reliable, current, or error-free. We reserve the right to bring new services, and/or take out certain line of our services at any time at our sole discretion.
 

AUTOMATIC RENEWAL
Service Subscriptions to MOIOTSO will automatically renew at the end of each billing cycle unless the Client cancels the subscription before the renewal date. By allowing the subscription to renew, the Client authorises the Service Provider to charge the provided payment method for the applicable subscription fees for the next billing cycle. Clients who do not wish to renew must cancel their subscription 30 days prior to the end of the current billing cycle to avoid being charged for the next cycle.
 

CANCELLATION

  • Clients can cancel their service or subscription anytime by sending an email to [email protected] and Services will continue until the end of the current billing cycle.
  • If Clients request immediate cancellation, access to services and work will be terminated immediately, and any remaining time in the current billing cycle will be forfeited.
  • Subscriptions and services will be automatically cancelled if payment is not made on time. Access to Services will be suspended until payment is made.
  • Upon cancellation, Clients will lose access to all services. Any associated data or content may be deleted, and the Service Provider is not obligated to retain or provide access to such data.
  • To avoid automatic renewal and associated fees, Clients must cancel their services and subscription before the end of the current billing cycle.
  • Any unused hours will be forfeited upon cancellation and are non-refundable.
     

RETURNS

You agree, that we do not sell goods and physical hardware, we do not ship any equipment or material therefore there is no return possible based on the services we provide.

REFUNDS
a) Refund Eligibility: Clients can request a refund if they are not satisfied with the service within the first 14 days of their initial purchase or date of invoice. However, the refunds may not be processed if the work has already been initiated or undertaken or the hours may be partially refunded based on the consumption, this is solely upon our discretion.
b) Non-Refundable Items: Hosting fees, or services purchased after the initial payment, and refund requests made after 14 days are not eligible for refunds.
Dedicated Resource service payments are non-refundable.
c) How to Request a Refund: Clients must email customer support at [email protected] stating the request in the subject line along with their business name and with their purchase details and the reason for the refund request.
d) Refund Process: Refund requests will be reviewed within 5 business days. Approved refunds will be processed within 5 business days after approval. The time it takes to appear in the Client’s account depends on their payment provider.
e) Transaction Fees: Any transaction fees charged by payment processors are non-refundable.

f) Any refund requests submitted after the start date of the project will not be accepted.
 

GOVERNING LAW AND DISPUTE RESOLUTION
If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales. 
 

UPDATES TO THIS POLICY
We may add to or change or update this Cancellation & Refund Policy at any time, from time to time, entirely at our own discretion, with or without any prior written notice. You are responsible for checking this Policy periodically. Your use of the services after any amendments to this Policy shall constitute your acceptance to such amendments.
